Their article, “Federal Deregulation Initiatives: Endangered Species Act & Water Quality Certification Rulemakings Efforts to Streamline Federal Permitting,” explores developments that further President Trump’s regulatory goals. They write, “The section 401 NOPR and ESA rules have each drawn praise and sharp criticism from interested participants, with challenges already filed against the ESA rules. While the comment period for the Section 401 NOPR has only just begun at the time of this publication, similar challenges are expected to be filed by environmental groups and states for the section 401 NOPR if finalized as proposed. As a result, it remains to be seen whether and to what extent these regulatory changes will affect the regulated community in the long run.”
