The Pepper Center for Public Service is pleased to announce the third in its series of programs exploring legal, historical, and policy issues relating to the United States’ relationship with American Indians. This one-hour webinar, scheduled for July 10, 2023, at noon eastern time, will discuss the U.S. Supreme Court's much anticipated decision in Haaland v. Brackeen, which was issued on June 15, 2023. That case involved a constitutional challenge to the Indian Child Welfare Act (ICWA), a 1978 law that governs child custody proceedings involving "Indian children" (a term defined by the Act). In a complex 7-2 decision involving five separate opinions, the Court’s majority opinion, written by Justice Amy Coney Barrett, upheld ICWA – a huge victory for tribal sovereignty interests - but it also left questions open.
Our featured speaker is Adrian (Addie) Tobin Smith, an attorney and expert on ICWA and child welfare/juvenile justice systems. In this presentation, Ms. Smith will discuss the background of ICWA, why it is so important to American Indian Nations and communities, and how ICWA is applied in addition to speaking on the Haaland decision.
Our first talk in the series, an introduction to American Indian Nations' sovereignty and jurisdiction in Indian Country, was held on May 1, 2023. Our second talk, held on June 8, 2023, explored legal, historical, and policy issues around American Indian treaty fishing rights in the Pacific Northwest.
