Justices Will Weigh Liability of Corporate Affiliates in TM Row
Michael Hobbs, a partner in Troutman Pepper's Intellectual Property Practice Group, was quoted in the June 24, 2024 Law360 article, " Justices Will Weigh Liability of Corporate Affiliates in TM Row."
The justices may be interested in analyzing whether the Fourth Circuit overreached in its damages analysis, or perhaps they believe the Lanham Act does provide "broad, equitable remedies," said Michael Hobbs Jr., a partner at Troutman Pepper Hamilton Sanders LLP.
"There may be justices of the Supreme Court that think a court needs to have broad application of Lanham Act principles and remedies because otherwise companies could set up shell companies and never face any monetary damages because the shell companies really have the profits," Hobbs said.
