Troutman Pepper Successfully Represents GoPlus and Costway in Enforcement of Arbitration Pact
Troutman Pepper successfully represented GoPlus Corp. and its affiliated Costway.com Inc. when the California Court of Appeals ruled that an arbitration pact between the online retailer and a former employee is enforceable. The ruling reverses a trial court decision and has the effect of defeating class action employment claims that exposed the client to millions of dollars in alleged liability.
Mark Payne, a partner with Troutman Pepper representing GoPlus and Costway, said the companies were feeling "gratified" with the appeal decision.
"It reinforces the commonsense conclusion that when an employee signs even a one-line agreement to submit all disputes to neutral arbitration, that that's valid and enforceable," he told Law360.
