We provide proactive compliance and risk management strategies for health care and life sciences companies, and advise and defend them in investigations or prosecution by federal and state authorities. We draw on our backgrounds as former corporate in-house counsel, federal and state prosecutors, and investigators to represent a wide range of clients in the health care and life sciences sector, including pharmaceutical manufacturers, acute care hospitals, academic medical centers, and specialty hospitals. Our experience includes defending clients targeted by the U.S. Department of Justice, the U.S. Department of Health and Human Services, the HHS-OIG, congressional oversight committees, individual U.S. attorneys offices, and state attorneys general.
We are experienced defending against enforcement actions under fraud and abuse laws, including the False Claims Act, the Anti-Kickback Statute, Medicare and Medicaid regulations, the Food, Drug and Cosmetic Act, the Prescription Drug Marketing Act, the U.S. Foreign Corrupt Practices Act (FCPA), health care fraud, and other criminal statutes. We also regularly assist health sciences clients with internal investigations into allegations of wrongdoing.
Our team identifies potential areas of enterprise risk and creates compliance programs. We conduct field testing of compliance plan design and operation using federal and state regulators' investigative techniques. This helps to proactively identify intentional misconduct and test compliance effectiveness through the lens of the applicable regulatory frameworks. We identify vulnerabilities and create remediation measures — such as plan and work-flow changes — before the regulators arrive.
