For decades, clients have turned to Troutman Pepper for skilled representation navigating natural resource-related regulations and related permitting, study and survey requirements associated with project development and facility operations. From renewable energy development to key infrastructure needed for energy security in the 21st century, natural resource issues have quickly become a central issue and potential bottleneck for many projects, and we leverage our significant experience to help our clients successfully address these complex and stakeholder-driven processes.
Our areas of concentration include:
We advise clients on the full range of federal and state protected species frameworks, from the potential impact of new legislative and regulatory developments to navigating the consultation and permitting process, including how best to manage the surveys, studies and administrative record associated with protected species impact assessments for projects. We have particular knowledge of and experience with species-related requirements associated with wind power, solar power, hydropower, mining operations, and pipelines.
NEPA counseling is the cornerstone of our natural resources practice. As with the ESA, and other protected species requirements, we advise clients on the changing regulatory requirements and strategies for efficiently and effectively completing the NEPA review process while balancing stakeholder feedback.
We draw on our thorough understanding of NHPA, the Section 106 process, and the underlying goals and principles of the Act to help our private- and public-sector clients address historic and cultural resources that may be encountered during project permitting and development, thus minimizing project delays and interruptions.
We understand that project development on federal lands adds an additional layer of complexity to project development. Our attorneys have years of experience with land exchanges and in managing responsibilities associated with projects affecting public lands. We bring that experience to bear on behalf of our clients.
