Whether facing an accidental release of chemicals, a facility emergency or simply preparing an emergency response contingency plan, clients call upon Troutman Pepper for our substantial experience in release reporting, chemical notifications, annual submissions, agency inspections, and related issues under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), the Emergency Planning and Community Right-to-Know Act (EPCRA), and state release reporting and notification statutes.
We represent chemical manufacturers, utilities, telecommunication providers, agricultural manufacturers and processors, and food processing companies on a wide range of release reporting issues, including agency enforcement involving failure to notify, delays in notification, and failure to follow up on notifications under CERCLA, EPCRA, and state requirements. If settlement falls short, we regularly defend clients in “show cause” hearings involving alleged release reporting violations. We regularly provide detailed training, mock inspections, and plant simulations to respond to agency inspections, search warrants, and third-party inquiries on release reporting.
We advise numerous clients on compliance under CERCLA, EPCRA, and related requirements regarding the proper reporting of and planning for chemical emergencies at the federal, state, and local government levels. We also counsel clients as they work with local governments to develop and annually review emergency response plans submitted by regulated entities.
At a broader level, we counsel policymakers on how to implement EPCRA soundly and efficiently. In Virginia, for example, we are currently assisting members of the Virginia General Assembly in developing and drafting a variety of methods for increasing public information regarding environmental conditions and citizen participation in the permitting process for most environmental media.
